On January 26th, Senate Finance Committee Chairman Orrin Hatch sent a letter to the incoming Secretary of HHS, Alex Azar, asking several questions about his plans to work with HRSA to “clarify program requirements” and stating that HHS consider moving administration and oversight of the 340B program from HRSA to CMS. In the letter, Hatch expresses concern over HRSA’s oversight and regulatory authority and limited resources in light of “the program’s recent and rapid growth.” Hatch asked Azar a number of questions, including the current level of coordination among HRSA, CMS, and HHS on administration of the program, whether HRSA has the resources to implement and enforce 340B requirements and to provide an update on the on-line database on ceiling price information.
